Late yesterday, the DOL released the explanatory notice that was referred to in the Families First Coronavirus Response Act (FFCRA). The notice is mandatory and must be posted by all covered employers immediately. The notice can be found here: https://www.dol.gov/agencies/whd/posters
The following is some additional information provided by the DOL. The Notice must be posted in a conspicuous place on the employer’s premises. This requirement can be satisfied by posting the notice in a lunchroom or other space accessible to all employees; by emailing or direct mailing this notice to employees; or by posting this notice on an employee information internal or external website.
Since the FFCRA takes effect on April 1, this notice does not have to be sent to employees who have already been laid off. Although it does not need to be provided to applicant, it does need to be provided to any new hire either by email, direct mail, or by posting this notice on the premises or on an employee information internal or external website.
This information is accurate as of March 25, 2020, and is subject to change based on any new legislation.
